QUOTE FROM A FRIEND: "When a man proves beyond doubt that he cannot pay a certain alimony amount and the Judge ignores this clear evidence, the only reasonable conclusion would be that the Judge and possibly the opposing lawyer are corrupt acting against the man

Does anyone reading this know the Attorney General or anyone high up in the European Court of Human Rights?

I am aware that if I directly accuse of corruption without proof, that in itself is a crime. I am not accusing anyone, but surely you can see why it is reasonable to assume corruption might be at stake!

Prove to me that this Judge and this Lawyer are Not Corrupt!

In short, I am being held hostage by the very own legal system that is supposed to protect my human rights!

NOTE: This is a true story based on true facts.

I submitted a court case to reduce my alimony while being unemployed from 550eur/mo to something i can actually afford to pay.
The case lasted 3 years, 42 arrest warrants later, 2 unemployment reports and full social insurance reports for the entire duration and my case gets dismissed with the excuse
"Hasn't proven that his financial status has changed"!!!
So basically, the official government documents, including unemployment reports and bank proofs, are not sufficient to prove my financial status!
Near the end fo the case, i mentioned in court that i have found now a job (Finally) and i get 1168euros.
Courts reply was:
"It doesnt matter what you make, what matters is how much you COULD be making"<-- Correct me if i am wrong but this is fundamentally wrong and against human rights!

A Refugee in my own country

I have tried to follow the system and it's laws down to the last letter
I've proven to the court that i am unable to pay (Now 670euros/mo) with official government documentation
3.5 years later, I am still a wanted man for unpaid alimonies
The monthly arrest warrants forbid me from doing my work abroad when necessary
I am forced to hide and avoid police in order not to get un-rightfully and unjustifiably arrested

In case you are wondering, I am writing about Cyprus... Supposingly a EUROPEAN country, and not some 3rd world banana republic!

HERE IS THE TIMELINE OF EVENTS

July 2016

Received a phone call from police saying I have an arrest warrant if I don't pay 6500euros! After asking for details I figured out it was "supposingly for unpaid alimonies".
Note, I had never received any notice to appear in court for the above!
Also note that before this call, I had lost my job a few months back, and rightfully I notified my ex about the situation, and the fact I will not be able to be paying the full 500euro alimony for a few months until I sort out my work situation and will be paying whatever I can every month, which I did. I also notified her that if there is any urgent need on a certain month to let me know so I can source funds from friends and relatives
Additionally, we had made an oral agreement, that since we have a co-owned property up for sale after our divorce, there is no need to go into courts and reduce this alimony, and whatever amounts accumulate she would get it with the sale of our property. After all, it's for our son!
All good so far, until we disagreed on a certain decision of her, leaving the island with my son, to experiment for a life in an unspecified European country (Prior to this, she wanted Canada in 2013, then Australia in 2015, both of which I helped fill up the paperwork and even gave exams). Her urge to "flee" wasn't sounding like a mature, adult, parent decision anymore so I rightfully disagreed.
Since then, I became a victim of a collapsing and possibly corrupt legal system with all details analysed below.

Note: I have reported the entire story to Social Services in early Oct 2016, including threats and blackmail that if I do not sign the childs custody over, she will forcefully put me in jail as she has a "VERY STRONG LAWYER". Needless to say, Social Services never got involved for this! Instead, when summoned by court about the custody case, an auditor from social services (Child support) attended our case and also never considered my report during that case!

Sep 2016

I received notice of a court case by my ex wife, claiming full custody of our son with false accusations that the father is not interested, not paying alimonies, etc,
And yet another arrest warrant for the amount of 2500euros, before I could even pay the first one.

Oct 2016

I filed a case for reducing the alimony since I was unemployed and appointed a defence lawyer to the aforementioned custody case.

Nov 2016 ~ July 2019

30+ Monthly appearances to explain "WHY I HAVENT PAID THIS MONTHS ALIMONY"!
And my answer was always the same:
"Because I have a case for XYZ months/years now to reduce this, I cannot afford to pay this much, I have 3~4 warrants already issued at any given time and before I manage to pay one, 2 more appear!
The court response was always the same: "We'll give you time, 30days, 2months, 3months"
Here I feel the need to give credit to one of the three Limassol Family Court Judges. I have throughout this case been in front of all three Judges and "He" displays an attitude that the people in front of him are human beings not case numbers. I wished and hoped that he would handle my case but unfortunately this is not the case.
To add further misery I have had another 30+ (over 60 in total) appearances for reduction of alimony and custody. The misery is compounded when my ex lives across the street and I have a 3 hour round trip from the Polis area!

Apr 2017

I was forced to move from Nicosia and shut down a small creperie business I had recently started for 2 reasons. Firstly I could not go to my work without police showing up and trying to arrest me, while any explanation I gave was met with "We have to do our job". Secondly I could not afford to pay rent 450/mo anymore with this high alimony and a British friend named Mike helped me out by offering me a free roof in Paphos at a holiday rental he owns and was planning to sell.
In return I helped with some repairs and did the viewings for interested clients.

Mid 2017

The first lawyer handling my case, appeared without my knowledge and withdrew from both my cases! This was a surprise and I now had 30 days to locate another lawyer to represent me otherwise the case would collapse.
After running from one legal firm to another in a panic to be represented (with little or no money) a friend of mine introduced me to a law firm who took me on making me feel back on track.!

Apr 2019

My friends place was no longer available as it got long term rented out. I had to move once more to Polis Area to the village where I grew up, and found a place to rent for 200/mo as the case was nowhere near seeing any light of completion!

Early 2019

Both cases áre still open.
Numerous arrest warrants for me
Monthly visits to court for both cases and unpaid alimonies reports
Submitted evidence upon request to court with full 5yr reports from social insurance, including 2 unemployment reports during this period.
Parallel to this, I notified the court that I now finally have a new job and because it is a startup we cannot get much out of it. 1168/mo was the salary.

Court response was: "It is irrelevant what you make now, what matters is how much you COULD be making"

July 2019

My alimony reduction case gets rejected with the following excuse:
"Hasn't proved that his financial status has changed"
If the official government documents are not enough, then what is?
Or another wild guess is, what the hell happened between the lawyer and judge handling this case?
I've taken every possible measure to prove to court it is humanly impossible to be paying the amount in dispute. What else am I supposed to do, go to jail for proof?

Months that followed

  • 1700 euros accumulated from non-enforcement of the automatic 10% increase while the case was un-resolved
  • 555 euros unpaid alimony
  • 555 euros unpaid alimony (Before second increase)
  • 610 euros unpaid alimony (After second increase)
  • 610 euros unpaid alimony (After second increase)
  • 610 euros unpaid alimony (After second increase)
  • 670 euros unpaid alimony - January 2020 (After third increase)
TOTAL DUE: 5310 euros
NOTE: I've been receiving significant pressure by the opposing lawyer lately to pay up the overdue to her! HINT anyone? It would appear I have been funding my exes lawyer this far

Actions taken

  • Tried reaching out to "General Commissioner and Human Rights office"
  • Audit Office of the Republic of Cyprus
  • Attorney General's Office
  • Cyprus Bar Association
ALL have replied back that "Family court is outside of their jurisdiction"
So in other words, the family court is above and beyond everyone in the government and if there is a discrepancy in it's processes NOBODY can interfere with!

12-feb-2020 Reply from Attorney General office

I was given a phone number to call and ask about my application to handle this matter and complaint, as well as protect me from illegal imprisonment.
The lady who answered focused on the fact that it relates to alimonies and they "CANNOT DO ANYTHING ABOUT THAT". She repeated this 3 times while I was urging her to forget the alimonies and read the accompanying letter (Basically everything mentioned above).
Unfortunately, I don't believe my application was even forwarded to the Attorney General himself!

July 31 ~ August 3, 2020 - Extortion not to report the abandonment of a minor

On Friday, July 31, I went to Limassol to pick up my son for his summer vacation. At 19:00 when I arrived my son was alone at home, he was talking to me from the door saying that he does not have a key to open for me and we have to wait for mom! As he told me, he was alone from 15:30!
His mother arrived 20 minutes later and handed him over to me. I have everything recorded in video! When I tried to confront her not to repeat it, she called me a liar and threatened that i will go to jail if i do anything stupid. In addition, while the young man was to stay with me from August 1st for 17 days (as provided by the court order), she came out of my house unexpectedly on Sunday and shouted for me to give our son to take him back to Limassol
With the involvement of police, the above-mentioned warrants were brought to surface and the attorney General's office is still in sleep mode since my application in January. Forced to take another loan so I can stay out of unjust imprisonment.
I had to hand over my son, in order to be given an "extension" (From her!!! cause the law has so many holes she has more rights than the father) until Tuesday to pay all the warrants.
I have reported the incident to the police again for the young man locked in the house, and since then I have attempted 50 phone calls in various parts of the welfare office in Limassol, I have left messages because everything goes to an answering machine, I have sent an email with the new complaint, and I can not talk to anyone.
On Monday I got to the office of the child protection commissioner and mentioned the above, closing with "I am worried about my child, his mother has confiscated the phone I bought for him and I can not contact him. "
I am expecting news... hopefully!
